PRIVACY POLICY Effective date: August 1, 2023 This Privacy Policy (hereinafter referred to as the “Policy”) regulates the relationship in the sphere of protection of personal data of visitors to the website https://dykaposhta.org/ (hereinafter referred to as the “Website”), owned by the CIVIC ORGANIZATION “WILD POST” (EDRPOU code: 41935759, 01042, Kyiv, Marii Pryimachenko Boulevard, building 1/27, office 304), registered in accordance with the current legislation of Ukraine (hereinafter referred to as the “Organization”).

    1. GENERAL PROVISIONS. 1.1. In this Policy, the terms are used as follows:
    • Personal data repository – a named collection of organized personal data in electronic form and/or in the form of personal data card files;
    • Consent of the subject of personal data – the voluntary expression of will of a natural person (provided they are informed) regarding the granting of permission for the processing of their personal data in accordance with the formulated purpose of their processing, expressed in a form that allows for the conclusion of consent;
    • Processing of personal data – any action or set of actions such as collection, registration, accumulation, storage, adaptation, alteration, retrieval, use, and dissemination (distribution, implementation, transmission), depersonalization, destruction of personal data, including using information (automated) systems;
    • Personal data – information or a set of information about an individual who is identified or can be specifically identified;
    • Subject of personal data – a natural person whose personal data is processed;
    • Third party – any person, except the subject of personal data, the owner or manager of personal data;
    • Cookie files – these are small text files that are stored in the browser of the device (computer, mobile phone, etc.) after visiting the Website, and which the Website transfers to the browser. All other terms in the Policy are used in the meaning defined by the current legislation of Ukraine, including the international legal acts ratified in Ukraine. 1.2. This Policy has been developed for the purpose of informing the subjects of personal data about the procedure for processing their personal data during the visit/use of the Website, as well as for the purpose of ensuring the protection of their personal data during such processing. 1.3. This Policy, as well as the activities of the Organization related to the collection, processing, storage, and other lawful actions regarding personal data, are regulated by:
    • The Constitution of Ukraine;
    • The Law of Ukraine “On Personal Data Protection” dated 01.06.2010 No. 2287-VI;
    • Other current regulatory legal acts of Ukraine regulating the issues of personal data protection;
    • International legal acts ratified in Ukraine. In relation to the legal relations arising in the Organization in connection with the processing of personal data of residents of foreign jurisdictions, the law (including international), national and international regulatory legal acts regulating the issues of personal data protection of residents of such countries are also applied. 1.4. The owner of personal data processed in connection with the visit/use of the Website options is the Organization. The Organization has the right to fully or partially entrust the processing of personal data to third parties based on a contract concluded in accordance with the requirements of the current legislation. 1.5. A natural person is a subject of personal data under this Policy if they are a visitor to the Website, including if they use any options available on the Website. 1.6. The Organization guarantees that:
    • It complies with proper practice and regulatory requirements for the protection of personal data;
    • It protects the rights of subjects of personal data;
    • It prevents the risk of breaches in the security of personal data processing. 1.7. The purpose of processing personal data obtained in the process of the Website’s functioning is the implementation of the Organization’s statutory activities. 1.8. Posting this Policy at the link indicated in clause 4.1. of this Policy is a notification to the subjects of personal data about the Owner, the composition, and content of personal data collected in connection with the visit/use of the Website, the rights of such subjects, the purpose of collecting their personal data, and third parties to whom such personal data may be transmitted.
  1. PROCESSING OF PERSONAL DATA. 2.1. The Organization may collect and process the following information about you: Information you provide to the Organization: this is information about you that you provide by using the Website and Website options, subscribing to receive updates by email, making charitable donations through the Website options, communicating with the Organization through options available on the Website, etc.; Information about you collected by the Website and other systems: 1) if you visit the Website, third parties may collect certain information about you and your visit, such as the type and version of your browser, as well as the pages on the Website you visit, your internet protocol (IP) address; 2) the Website may also download cookies to your device; 3) if you contact the Organization’s employees through the Website or other electronic communication means; Information collected by third parties about you on the Website through actions: this is information about you that you provide to third parties (such as Facebook, Google, Twitter) using options for social media sharing available on the Website, by navigating from one page to another or by viewing materials that have links (open) to other platforms (websites). 2.2. How the Organization processes your personal data depends on how you use the Website and interact with it. Some information may be provided directly by you when using the Website or in another way; other information the Organization may collect and process independently through automated technologies used on the Website. 2.3. Legal grounds for data processing: when visiting the Website, the Organization processes your personal data if 1) the Organization has obtained your consent for such processing, 2) your personal data is necessary for the Organization to conclude and execute an agreement with you or to take measures preceding the conclusion of an agreement, 3) in cases where the Organization has a legitimate interest in processing your personal data, and this legitimate interest does not override your interests regarding data protection or your fundamental rights and freedoms, as well as 4) in other cases specified by the current legislation. In some cases, the Organization may have a legal obligation to process your personal data or will process your personal data to form, execute, or defend legal claims. 2.4. Mechanisms of automated processing: the Organization and third parties may use automated information processing technologies to process information in certain sections of the Website. The Organization uses cookies to store content and settings, allowing the Organization to process standard information that your browser sends to certain websites you visit, such as your IP address, browser type and language, as well as the website you came from, pages you visit, and links you click on the Website. The presence of such technical information helps the Organization improve the Website. 2.5. The Organization may use your personal data only for the purpose and in the ways defined by this Policy and the applicable law, including (but not limited to), 1) to process your request (inquiry) to the Organization made through the Website, 2) to ensure your charitable donations (contributions) through options available on the Website, 3) to achieve other statutory purposes of the Organization in the manner determined by the current legislation. 2.6. The Organization may accumulate personal data processed during your visit/use of the Website, including by entering this data into the personal data repository. Storage of your personal data is carried out in compliance with the requirements of the current legislation in the field of personal data. 2.7. The dissemination of your personal data is carried out solely with your consent or in cases specified by this Policy and the applicable law. 2.8. The Organization may partially publish user data on its Website in the Reporting, Receipts section. 2.9. Your personal data will be deleted or destroyed in case of: expiration of the 2-year storage period or another period determined by the current legislation; termination of legal relations between the subject of personal data and the Organization, if otherwise provided by law; in other cases determined by the current legislation in the field of personal data protection. 2.10. The Organization does not process personal data about racial or ethnic origin, political opinions, religious or philosophical beliefs, membership in political parties and professional associations, criminal convictions, as well as data related to health, sex life, biometric or genetic data, except as provided by law.
  1. RIGHTS OF PERSONAL DATA SUBJECTS. 3.1. When visiting/using the Website, you have the right to: receive information from the Organization not specified in this Policy regarding the processing, terms of access to your personal data or provide the appropriate authorization for obtaining this information by persons authorized by you, except as provided by law; free access to your personal data; receive a response to a request regarding the processing of your personal data in the manner and within the timeframe determined by the current legislation; submit a motivated request objecting to the processing of your personal data or regarding the modification or destruction of your personal data if such data is processed unlawfully or is inaccurate; the protection of your personal data from unlawful processing and accidental loss, destruction, damage due to deliberate concealment, non-provision, or untimely provision, as well as protection from the provision of information that is inaccurate or defames the honor, dignity, and business reputation of an individual; withdraw your consent to the processing of personal data; as well as exercise other rights determined by the current legislation in the field of personal data protection. 3.2. You have the right to contact the Authorized Human Rights Commissioner of the Verkhovna Rada of Ukraine with questions related to the collection, use, storage, and other processing of your personal data, who can be contacted via the email address hotline@ombudsman.gov.ua.   1. PRIVACY POLICY CHANGES. 4.1. The Organization reserves the right to review and modify the provisions of this Policy. The current version of this Policy is posted on the Website at the following link: https://dykaposhta.org/.
